1. Introduction
Welcome to Actify (“Service”, “Platform”, “We”, “Us”, or “Our”). By accessing or using Actify, you (“User”, “You”, or “Your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
Actify is a Model Context Protocol (MCP) based code execution platform that enables AI agents and users to execute Node.js code on-demand via secure, isolated cloud infrastructure.
2. Key Definitions
- Service: The Actify platform, including the MCP server, API, web interface, and all related services
- Workflow: User-submitted code packaged and executed as secure jobs
- Execution: The process of running a Workflow in our secure cloud infrastructure
- Credits: Virtual currency units used to pay for resource consumption on the Platform
- User Code: Any code, scripts, or data submitted by You to the Service for execution
3. Acceptance of Terms
By creating an account, accessing the Service, or executing code through our Platform, You represent that:
- You are at least 18 years of age or have reached the age of majority in your jurisdiction
- You have the legal authority to enter into this agreement
- You will comply with all applicable laws and regulations
- All information provided during registration is accurate and complete
6. Acceptable Use Policy
6.2 Prohibited Activities
You must NOT use the Service to:
Security and Legal Violations
- Execute malicious code, malware, viruses, or exploits
- Attempt to gain unauthorized access to our systems or other users' accounts
- Violate any applicable laws, regulations, or third-party rights
Resource Abuse
- Cryptocurrency mining or blockchain validation
- Distributed denial-of-service (DDoS) attacks
- Excessive resource consumption beyond purchased credits
7. Credits and Billing
- Credit Purchase: Credits must be purchased to use execution resources
- Resource Consumption: Execution time, CPU, memory, and storage consume credits
- Credit Deduction: Credits are deducted in real-time based on actual usage
- Non-Refundable: All payments are non-refundable unless required by law
8. Intellectual Property
Your Code and Data: You retain all intellectual property rights to your User Code, execution results, and data stored in your workflows. By using the Service, you grant us a limited license to store, process, and execute your code.
Our Platform: We retain all rights to the Actify platform, MCP server, infrastructure, trademarks, logos, and proprietary technology.
10. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTIFY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions, data loss, or security breaches
- Damages exceeding the amount paid by you in the last 12 months
12. Termination
You may terminate your account at any time. We may terminate or suspend your account for violations of these Terms, illegal or abusive activity, or if required by law.
Upon termination, your access is immediately revoked, your data may be deleted after a grace period (30 days), and outstanding payments become immediately due.
13. Dispute Resolution
These Terms are governed by the laws of the State of California, United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except small claims court actions (under $10,000), intellectual property disputes, and injunctive relief requests.
16. Specific Service Terms
16.2 Kubernetes Execution
Execution environment limitations:
- Maximum execution time: 5 minutes (configurable with paid plans)
- CPU and memory limits as specified in your plan
- Network access: Outbound HTTPS allowed, inbound connections blocked
- File system: Ephemeral storage only
